Understanding Apprehended Violence Orders
Apprehended Domestic Violence Order (ADVO)
CRIMES (DOMESTIC AND PERSONAL VIOLENCE) ACT 2007 (NSW)
ADVOs apply when the protected person and defendant are in a domestic relationship, including current or former partners, family members, or people living in the same household.
- Police-initiated applications are common following domestic incidents
- Provisional orders can be issued immediately by police
- Standard conditions include no assault, threats, or stalking
- Additional conditions may restrict contact and proximity
Apprehended Personal Violence Order (APVO)
CRIMES (DOMESTIC AND PERSONAL VIOLENCE) ACT 2007 (NSW)
APVOs apply to all other relationships, including neighbours, colleagues, acquaintances, or strangers. The applicant must initiate the application themselves.
- Private applications require filing at Local Court
- Applicant must prove grounds for protection
- Often used in neighbour disputes or workplace conflicts
- Can be contested at a defended hearing
